EAU CLAIRE Wis. (WLAX/WEUX) – New video shows the moment when Eau Claire police officers fired at a man who pointed a gun at them. It happened on September 4th in the 1900 block of Declaration Drive.
Police responded to the home on a report a man was being disorderly and pointing a gun at neighbors. When officers got there, they found Clayton Livingston in the garage with a gun. Officers repeatedly told him to drop it.
The video then shows Livingston aiming the gun at officers before he is shot several times. Police then provided medical care and took him to a hospital, where he survived.
The Eau Claire Police Department concluded its review of the incident and found the two officers who shot him acted appropriately. In December, the Eau Claire County district attorney also determined the officer’s actions were reasonable acts of self-defense and the defense of others.
Livingston was charged in January with two counts of 2nd-degree recklessly endangering safety and possession of a firearm while intoxicated. The Eau Claire Police Department says his blood alcohol concentration was .216 at the time of the shooting.
