EAU CLAIRE Wis. (WLAX/WEUX) – A man shot by two Eau Claire police officers after allegedly pointing a gun at them is charged. 38-year-old Clayton Livingston is charged in Eau Claire County with two counts of 2nd-degree recklessly endangering safety and possession of a firearm while intoxicated.

According to the criminal complaint, Livingston pointed a gun at a neighbor’s home on the night of September fourth last year. Witnesses called 9-1-1 saying Livingston was acting strangely with a gun in his garage and yard.

Police officers say Livingston never fired the gun but did point it at officers. The responding officers then shot Livingston. According to the Eau Claire DA’s office. The actions of the two responding officers were reasonable. Livingston was treated at the scene and taken to a hospital following the shooting.
